Terms & Conditions
All sales made by Vivi Vintage, LLC ("Seller") to you ("Customer") are governed by these Terms and Conditions of Sale unless otherwise indicated by “Seller” in writing.
PLEASE READ THESE TERMS
These Terms and Conditions of Sale also apply to all future transactions unless modified in writing signed by Seller and Customer.
Payment Terms
SELLER ships orders and accepts Visa/MasterCard, and American Express.
All credit card orders will be charged before shipment. Once CUSTOMER makes a purchase, the item(s) shall be considered purchased even if the item(s) have not yet been shipped.
Shipping
Customer is responsible for all shipping and freight charges. Orders are normally shipped via
All items shipped by SELLER will include tracking so that both SELLER and CUSTOMER can track the transit and receipt of the item(s).
Customer must notify Seller at time of purchase if a signature is required for residential deliveries. Seller is not liable for any lost or stolen goods that are delivered to a residence without requiring a signature.
Promotional Codes, Coupons, Discounts
Discounts cannot be combined with any other promotional offer at time of redemption, nor can they be applied to previous purchases or gift certificates. Discount does not apply to tax, shipping and handling, or similar processing charges.
Returns and Cancellations
UNDER NO CIRCUMSTANCES WILL SELLER ACCEPT CLAIMS ON MERCHANDISE WHICH
Items listed below cannot be returned whatsoever:
-footwear (including but not limited to: shoes, sandals, boots, etc.), handbags, wallets, scarves, jewelry, swimwear, belts, accessories, fur coats, leather jackets, and any and all items indicated couture.
-all items under $100.00 are not returnable
It is the CUSTOMER’s responsibility to confirm with SELLER prior to purchase in regards to which item(s) can and cannot be returned or cancelled.
Return Process for All Applicable Items: CUSTOMER must contact SELLER within 24 hours of receipt and advise as to the request to return merchandise.. This must be done PRIOR to shipping back any item(s). CUSTOMER must ship the item(s) back to SELLER with a tracking number. Item(s) must be back in the mail to seller within 48 hours of receipt. SELLER is not responsible for items returned by CUSTOMER without tracking via DHL, UPS, Fed-Ex, United States Postal Service, or other courier.
Refunds will be made in accordance with payment type made for the purchase. Shipping, Freight, and Handling charges will NOT BE REFUNDED.
If SELLER does not receive the returned item back, no refund will be made. Refund will be made when the item has been received back by SELLER and has been inspected for altering, damage, wear, use, scent, etc.
If SELLER determines that the item(s) has been altered in anyway, SELLER will not refund the purchase.
- A 20% (twenty percent) restocking fee assessed to all returned items.
-All item tags must be attached and not altered in any way.
o If any tags are altered or missing, item cannot be returned.
Representation, Warranty, Defects, & Typographical Errors
In the event that SELLER’s product is mistakenly listed at an incorrect price, SELLER reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. SELLER reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, SELLER shall issue a credit to your credit card account in the amount of the incorrect price.
This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, SELLER disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. SELLER does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. SELLER does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.
SELLER uses reasonable efforts to describe the condition, color, size, and other relevant information about the items for sale. Due to camera quality, pixilation, screen resolution, and other technological variables, some items may not appear exactly as viewed on the website. It is the CUSTOMER’s responsibility to ask all questions regarding item(s) prior to purchase.
Unless otherwise indicated, all items sold by SELLER are considered used and may have scratches, holes, rips, tears, stains, scents, and other defects. While SELLER makes reasonable efforts to point out any such defects, CUSTOMER agrees not hold SELELR liable for any unaccounted defects.

In an attempt to provide increased value to our visitors, SELLER may link to sites operated by third parties. However, even if the third party is affiliated with SELELR, SELELR has no control over these linked sites, all of which have separate privacy and data collection practices, independent of SELLER. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, SELELR seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
Customer Acceptance of Late or Defective Merchandise
Customer’s failure to provide written notice of a claim, as set forth in these Terms and Conditions of Sale, shall constitute a waiver of any claim Customer may have for damages resulting from such defects, including late delivery.
In the event there is a gross misrepresentation by SELLER of an item, CUSTOMER will contact SELLER within 48 hours of receipt. If SELLER does not contact CUSTOMER with 48 hours from receipt, CUSTOMER acknowledges that any such misrepresentation is acceptable and waives their right to pursue any such claim.
DISCLAIMER OF WARRANTIES
SELLER CANNOT GUARANTEE VARIANCES IN COLOR, SHADE, SIZE
LIMITATION ON LIABILITY
CUSTOMER ACKNOWLEDGES THAT SELLER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES (EVEN IF SELLER
Customer's Credit Worsens
Seller has the right, in addition to other remedies provided by the law, to terminate any delivery or suspend further deliveries of other shipments in the event Customer fails to pay for any shipment when the same becomes due. Should Customer's financial condition become unsatisfactory to Seller, in Seller’s sole discretion, Seller may require cash payments in advance or other security satisfactory to Seller prior to shipment of merchandise.
Jurisdiction/Governing Law
Seller is headquartered in the State of
Customer expressly agrees that exclusive jurisdiction for any dispute with Seller, or in any way relating to these Terms and Conditions of Sale, resides in the courts of the State of New Jersey and you further agree and expressly submit to the personal and exclusive jurisdiction of the courts of the State of New Jersey in connection with any such dispute including any claim involving the merchandise or Seller or its affiliates, subsidiaries, employees, contractors, officers, directors.
Force Majeure
Neither Buyer nor Seller shall be liable to the other for delays in performance of its obligation hereunder caused by acts of God, war (declared or undeclared), government regulation, terrorism, disaster, strikes, civil disorder, curtailment of transportation facilities, or similar occurrence beyond the party's control, making it impossible, illegal, or commercially impracticable for one or both parties to perform its obligations under these Terms and Conditions of Sale, in whole or in part.

Miscellaneous
These Terms and Conditions of Sale constitute the entire agreement between Seller and Customer, superseding any prior agreements between Customer and Seller. The failure of Seller to exercise or enforce any right or provision of these Terms and Conditions of Sale shall not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms and Conditions of Sale must be filed within one (1) year after such claim or cause of action arose or be forever barred.
